Evidence of this character, even if it had been more precise and definite, would not be considered admissable, unless the absence of higher and more reliable testimony were satisfactorily explained. With this view, I addressed a note to Messrs. Gibbons and Kelly, requesting the production of such vouchers in support of the expenditures charged as they might have in their possession; requesting, also, that if they were unable to produce the vouchers, they would slate the reasons therefor, and as the next best evidence, produce their books of accounts kept at the time, if any such were in tneir possession. In reply to these inquiries and others of a similar character subsequently proposed, I have received two letters from the claimants (marked A and B) stating, that no account of disbursements separate from their general accounts were kept by their agents, and no vouchersfor these particular disbursements were taken by them, and that such vouchers and books as they had preserved up to the period of the loss of the Oriole, were lost in the wreck, and that the books they have saved throw no light upon the subject of these charges. Being thus obliged to confine my investigations to such testimony as was stated to be within their reach, and finding the affidavits and statements above referred to wholly deficient in specifications, I requested the claimants to furnish a detailed statement of expenditures, in which the different items should be as distinctly particularized as their recollections and those of the deponents would admit.
